These Terms of Service ("Terms") govern your access to and use of Afterimage, including the Afterimage website, applications, features, and related services (collectively, the "Service").
Afterimage is operated by Afterimage.social ("Afterimage," "we," "us," or "our").
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree to these Terms, you may not use the Service.
1. Eligibility
You must be at least 18 years old to create an Afterimage account or use the Service.
By using Afterimage, you represent and warrant that:
You are at least 18 years old;
You have the legal capacity to agree to these Terms;
You are not prohibited from using the Service under applicable law; and
Your use of the Service will comply with these Terms and all applicable laws and regulations.
We may request information reasonably necessary to verify your eligibility to use the Service.
2. Your Account
Some features of Afterimage require an account.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity that occurs through your account.
You agree to provide accurate information when creating or maintaining your account and to keep that information reasonably current.
You may not:
create an account for another person without authorization;
impersonate another person, organization, or entity;
use another person's account without permission;
sell, transfer, or otherwise provide your account to another person without our permission;
create accounts for the purpose of evading a suspension, ban, or other enforcement action; or
use automated methods to create accounts except where expressly permitted by us.
You should notify us promptly if you believe your account has been compromised.
3. The Afterimage Service
Afterimage is a social publishing and microblogging platform that allows users to create, publish, discover, share, and interact with content.
Depending on the features available at a particular time, the Service may allow you to:
create text and media posts;
upload images, animated images, videos, and other supported media;
create public, unlisted, or draft posts;
like or otherwise interact with posts;
reblog or share posts;
use tags;
discover content through feeds, Explore, Gallery, search, tags, and similar features;
manage your profile and previously created content; and
use other social and publishing features provided by Afterimage.
We may add, modify, limit, suspend, or discontinue features at any time.
4. Post Visibility
Afterimage may provide different visibility options for content.
Public Posts
Public posts may be visible to anyone and may appear on profiles, feeds, search results, tags, Explore, Gallery, or other discovery surfaces.
You should assume that anything you publish publicly can be viewed, copied, shared, captured, archived, or otherwise retained by other people.
Unlisted Posts
Unlisted posts are intended to be accessible primarily through their direct link and may be excluded from normal discovery features.
Unlisted does not mean private.
Anyone who obtains the link to an unlisted post may be able to access or share it.
Drafts
Drafts are intended to be private to you and, where necessary for administration, security, support, or moderation, authorized Afterimage personnel.
Drafts are not intended to appear publicly in profiles, feeds, search, tags, Explore, Gallery, or similar public areas.
No Internet-connected system can provide an absolute guarantee against unauthorized access. You should not use drafts as a secure storage system for highly sensitive information.
5. Your Content
"User Content" means any text, images, video, audio, profile information, tags, links, or other material that you submit, upload, publish, or otherwise make available through Afterimage.
You retain ownership of any intellectual property rights you hold in your User Content.
You are responsible for your User Content and for ensuring that you have the rights necessary to upload and publish it.
By submitting User Content to Afterimage, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and distribute that content as reasonably necessary to:
operate and provide the Service;
display your content according to the visibility settings you select;
provide features such as feeds, profiles, tags, search, Explore, Gallery, and reblogs;
create technical copies, thumbnails, previews, transcodes, or other formats necessary to deliver the content;
protect, maintain, troubleshoot, and improve the Service; and
comply with applicable law and valid legal process.
This license does not transfer ownership of your User Content to Afterimage.
Where Afterimage allows another user to reblog, share, quote, or otherwise interact with your public content, you authorize Afterimage to display your content as necessary to provide that feature.
If you delete User Content, we will stop displaying it through the Service within a reasonable period, subject to technical limitations, backups, caching, legal obligations, enforcement records, and content that may have been independently captured or shared outside of Afterimage.
6. Mature and Adult Content
Afterimage may permit certain mature or sexually explicit content where allowed by law and by our Community Guidelines.
If you post mature or adult content, you are responsible for correctly labeling or categorizing that content using any tools provided by Afterimage.
Afterimage may restrict, obscure, filter, exclude from discovery, or otherwise limit mature content, including through user-controlled adult-content preferences.
The ability to post adult content does not permit unlawful, abusive, exploitative, or nonconsensual sexual content.
You may never upload, publish, request, distribute, promote, or link to:
child sexual abuse material;
sexual or sexually suggestive material depicting a person under 18;
sexualized depictions of a person who appears to be under 18;
content that sexually exploits a minor;
nonconsensual intimate images;
intimate imagery distributed without the depicted person's consent;
sexually explicit deepfakes or other intimate digital forgeries created or distributed without the depicted person's consent;
hidden-camera sexual content;
sexual content obtained through coercion, trafficking, extortion, or exploitation; or
any sexual content prohibited by applicable law.
We may immediately remove such content and suspend or terminate accounts associated with it.
Where required or appropriate, we may preserve evidence and make reports to law enforcement, the National Center for Missing & Exploited Children, or other appropriate authorities.
7. Prohibited Content and Conduct
You may not use Afterimage to engage in unlawful, abusive, deceptive, harmful, or disruptive conduct.
This includes using the Service to:
violate any applicable law or regulation;
threaten, stalk, intimidate, or harass another person;
promote or coordinate credible violence against a person or group;
publish another person's sensitive personal information for the purpose of harassment, intimidation, or harm;
impersonate another person or deceptively misrepresent your identity or affiliation;
exploit, endanger, groom, or sexually abuse minors;
publish nonconsensual intimate imagery or intimate digital forgeries;
infringe copyright, trademark, privacy, publicity, or other rights belonging to another person;
distribute malware, malicious code, phishing pages, credential theft tools, or other harmful software;
interfere with or attempt to circumvent Afterimage's security, access controls, content restrictions, moderation tools, or technical safeguards;
access another person's account or nonpublic content without authorization;
scrape, crawl, or automatically collect information from the Service in violation of our published rules or technical restrictions;
send spam or engage in coordinated inauthentic activity;
manipulate engagement or platform features through deceptive automation;
conduct fraudulent activity;
evade a suspension, account restriction, content restriction, or other enforcement action; or
encourage, assist, or facilitate conduct prohibited by these Terms.
These examples are not exhaustive.
Additional restrictions may be described in our Community Guidelines.
8. Moderation and Enforcement
Afterimage may review, restrict, label, hide, remove, or disable access to content that we reasonably believe violates these Terms, our Community Guidelines, applicable law, or the rights or safety of others.
We may also:
issue warnings;
limit the visibility or distribution of content;
disable specific features;
require content to be labeled as mature or sensitive;
prevent content from appearing in discovery features;
temporarily restrict an account;
suspend an account;
permanently terminate an account; or
take other reasonable measures to protect the Service and its users.
We are not required to publish, distribute, or continue hosting any particular User Content.
Content removed by an administrator or moderator may not be restorable by the author.
We may consider the severity, frequency, context, and history of violations when making enforcement decisions.
We may act immediately where we believe content or conduct creates a significant legal, security, or safety risk.
9. Reporting Content
Afterimage may provide tools for reporting posts, accounts, or other content.
Reports should be made in good faith.
Submitting knowingly false, fraudulent, abusive, or repetitive reports may itself violate these Terms.
We may investigate reports and take whatever action we reasonably determine is appropriate. Except where required by law, submitting a report does not guarantee removal of content or a particular enforcement outcome.
10. Nonconsensual Intimate Images
Afterimage prohibits the publication or distribution of nonconsensual intimate imagery, including qualifying digitally altered or artificially generated intimate images.
If you believe an intimate image of you has been published on Afterimage without your consent, you may submit a removal request at:

You do not need an Afterimage account to submit such a request.
A valid removal request should identify the content at issue and provide the information reasonably necessary for us to locate the content and process the request.
Afterimage will process valid requests in accordance with applicable law, including applicable requirements concerning removal of reported content and known identical copies.
Misrepresenting that you are the person depicted in content, or that you are authorized to act for that person, may violate these Terms and applicable law.
11. Copyright and Intellectual Property
You may only upload content that you own or have permission or another lawful basis to use.
Afterimage respects intellectual property rights and may remove material that infringes the rights of others.
If you believe content on Afterimage infringes your copyright, you may submit a copyright notice to our designated copyright contact:

Your notice should include the information required by applicable copyright law.
We may provide appropriate counter-notice procedures where required.
Accounts belonging to repeat copyright infringers may be suspended or terminated when appropriate.
12. Privacy
Our collection, use, storage, and disclosure of personal information is described in the Afterimage Privacy Policy.
The Privacy Policy is separate from these Terms but forms an important part of your relationship with Afterimage.
By using the Service, you acknowledge that you have had an opportunity to review the Privacy Policy.
13. Security
You may not probe, scan, test, bypass, or attempt to defeat security measures protecting Afterimage except through an authorized security testing or vulnerability disclosure program expressly provided by us.
You may not attempt to:
obtain unauthorized access to accounts, servers, databases, files, or administrative functions;
exploit vulnerabilities for purposes other than good-faith reporting through an authorized process;
interfere with the availability or operation of the Service;
overwhelm or disrupt our infrastructure; or
obtain data that you are not authorized to access.

14. Third-Party Services and Links
Afterimage may contain links to third-party websites, content, applications, or services.
We do not control third-party services and are not responsible for their content, availability, security, privacy practices, or terms.
Your use of third-party services is governed by the terms and policies of those third parties.
15. Availability and Changes to the Service
We work to maintain the availability and reliability of Afterimage, but we do not guarantee uninterrupted or error-free operation.
The Service may be temporarily or permanently unavailable because of maintenance, upgrades, technical problems, security incidents, legal requirements, circumstances outside our control, or other reasons.
We may modify, replace, discontinue, or restrict any portion of the Service.
Where reasonably practical, we may provide advance notice of significant changes, but we are not required to do so in every circumstance.
16. Account Suspension and Termination
You may stop using Afterimage at any time.
Where account deletion functionality is available, you may request deletion of your account through the Service.
We may restrict, suspend, or terminate your access to Afterimage if we reasonably believe:
you violated these Terms or our Community Guidelines;
your account creates a security or legal risk;
your activity threatens the safety or rights of another person;
you engaged in fraud, abuse, or unlawful activity;
you repeatedly infringed intellectual property rights;
we are required to do so by law; or
continued access would materially harm Afterimage, its users, or third parties.
We may terminate the Service as a whole.
Sections of these Terms that by their nature should survive account termination will remain in effect, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.
17. Feedback
If you voluntarily provide ideas, suggestions, or feedback regarding Afterimage, you grant us permission to use that feedback without restriction or compensation to you.
This does not give us ownership of unrelated User Content that you publish through the Service.
18. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFTERIMAGE AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE."
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
THE SERVICE WILL ALWAYS BE AVAILABLE, SECURE, OR ERROR-FREE;
CONTENT WILL ALWAYS BE PRESERVED OR AVAILABLE;
INFORMATION PROVIDED BY USERS WILL BE ACCURATE OR RELIABLE;
DEFECTS WILL ALWAYS BE CORRECTED; OR
THE SERVICE WILL MEET YOUR PARTICULAR REQUIREMENTS.
Some jurisdictions do not permit certain warranty disclaimers, so portions of this section may not apply to you.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFTERIMAGE, ITS OPERATOR, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
THIS INCLUDES, WITHOUT LIMITATION, DAMAGES RESULTING FROM:
LOSS OF DATA;
LOSS OF CONTENT;
LOST PROFITS OR REVENUE;
BUSINESS INTERRUPTION;
UNAUTHORIZED ACCESS TO AN ACCOUNT;
USER CONTENT;
ACTIONS OF OTHER USERS; OR
INABILITY TO ACCESS OR USE THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
the amount you paid Afterimage during the twelve months immediately preceding the event giving rise to the claim; or
US $100.
Nothing in these Terms limits liability where such limitation is prohibited by law.
20. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Afterimage and its operator, affiliates, officers, directors, employees, contractors, and agents from claims, liabilities, damages, judgments, losses, costs, and reasonable legal fees arising from or relating to:
your User Content;
your violation of these Terms;
your violation of applicable law;
your infringement or violation of another person's rights; or
your misuse of the Service.
This provision does not require you to indemnify us for claims resulting solely from our own unlawful conduct where such indemnification is prohibited by law.
21. Governing Law and Venue
These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-law principles.
Except where applicable law requires otherwise, any legal action arising from or relating to these Terms or the Service must be brought in the state or federal courts located in [COUNTY, STATE], and you consent to the personal jurisdiction of those courts.
Nothing in this section prevents either party from seeking appropriate emergency or injunctive relief where permitted by law.
22. Changes to These Terms
We may update these Terms from time to time.
When we make material changes, we may provide notice through the Service, by email, or through another reasonable method.
The updated Terms will state their effective date.
By continuing to use Afterimage after revised Terms become effective, you agree to the revised Terms.
If you do not agree to the revised Terms, you must stop using the Service.
23. Severability
If a provision of these Terms is found to be invalid or unenforceable, that provision will be limited or modified to the minimum extent necessary, and the remaining provisions will continue in effect.
24. No Waiver
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision in the future.
25. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign these Terms as part of a merger, acquisition, corporate reorganization, sale of assets, or other transfer of the Service or its operator.
26. Entire Agreement
These Terms, together with any policies expressly incorporated into them, constitute the agreement between you and Afterimage concerning your use of the Service.
If there is a conflict between these Terms and a separate agreement that we have expressly entered into with you, the separate agreement will control to the extent of that conflict.
